BikeTaxi - Terms of Use

Welcome to BikeTaxi.lk ("we," "our," or "us"). These Driver Terms of Use ("Terms") govern your access to and use of our ridesharing platform as a driver ("Driver" or "you"). By registering and providing services through our platform, you agree to comply with these Terms. If you do not agree, you may not use the platform.

1. Eligibility

To become a Driver on BikeTaxi.lk, you must:

Be at least 18 years old.
Hold a valid driver's license, insurance, and vehicle registration.
Have a roadworthy vehicle that complies with all local laws and regulations.
Successfully complete our onboarding and verification process.

2. Account Registration and Obligations

a. Creating an Account

You are required to create and maintain an account to use the platform as a Driver.
Provide accurate, current, and complete information during registration.
Update your account promptly if any of your details change.

b. Account Security

You are responsible for safeguarding your account credentials.
Notify us immediately of any unauthorized use or security breaches.

c. Use of Account

Your account is personal to you and cannot be transferred or assigned.
You are solely responsible for all activities conducted through your account.

3. Driver Responsibilities

a. Providing Rides

Respond promptly to ride requests and arrive at the pickup location on time.
Deliver passengers to their drop-off locations safely and efficiently.
Maintain a professional and respectful attitude toward passengers.

b. Vehicle Standards

Ensure your vehicle is clean, well-maintained, and meets safety standards.
Display any required permits or identification as mandated by local authorities.

c. Compliance with Laws

Abide by all traffic rules, regulations, and applicable laws while using the platform.
Do not engage in illegal activities or carry prohibited items while providing rides.

d. Reporting and Feedback

Report any incidents or accidents promptly to BikeTaxi.lk.
Accept and implement feedback provided by passengers or the platform for service improvement.

4. Earnings and Payments

Drivers will earn fees for completed rides based on the rates specified by BikeTaxi.lk.
Payments will be processed and disbursed to the Driver’s registered bank account or preferred payment method.
BikeTaxi.lk may deduct applicable service fees or taxes before disbursing payments.
Drivers are responsible for complying with any tax obligations arising from their earnings.

5. Prohibited Activities

Drivers must not:

Provide false or misleading information to BikeTaxi.lk or passengers.
Use the platform while under the influence of alcohol, drugs, or any impairing substances.
Engage in discriminatory, abusive, or illegal behavior toward passengers or others.
Solicit passengers outside the platform.

6. License and Restrictions

We grant you a limited, non-exclusive, non-transferable license to access and use the platform for providing rides. You may not:

Modify, copy, or distribute the platform’s content.
Attempt to reverse-engineer or interfere with the platform’s functionality.
Use the platform for unauthorized or unlawful purposes.

7. Suspension and Termination

BikeTaxi.lk reserves the right to suspend or terminate your access to the platform if you:

Breach these Terms.
Fail to meet safety or service standards.
Violate applicable laws or regulations.

Upon termination, you must cease using the platform immediately, and any pending payments will be settled as per platform policies.

8. Indemnification

You agree to indemnify and hold BikeTaxi.lk harmless from any claims, damages, or losses arising from:

Your use of the platform.
Your breach of these Terms.
Your violation of any laws or third-party rights.

9. Limitation of Liability

To the maximum extent permitted by law:

BikeTaxi.lk is not liable for indirect, incidental, or consequential damages arising from your use of the platform.
We do not guarantee the availability or uninterrupted functionality of the platform.
Your use of the platform is at your own risk.

10. Modifications

We may update these Terms periodically. Updated Terms will be posted on our website and app with the "Effective Date." Your continued use of the platform constitutes acceptance of the updated Terms.

11. Governing Law and Dispute Resolution

These Terms are governed by the laws of Sri Lanka. Any disputes arising from these Terms or the platform shall be resolved through mediation or arbitration in Sri Lanka.
